How buying, the Discord and support work.

A.1 Who we are

Misschevious Marketplace ("we", "us") creates and licenses resources for FiveM servers. Purchases are processed by Tebex Limited, who act as merchant of record and are the seller for the purposes of your transaction.

A.2 What you are agreeing to

By purchasing a resource, joining our Discord, or using anything we produce, you agree to these Terms of Service, the Terms of Use in Document B, and the Refund Policy in Document C.

If you do not agree, do not purchase and do not use the resources.

A.3 Eligibility

You must meet Discord's minimum age requirement and be capable of entering a binding agreement in your jurisdiction. If you are buying on behalf of a community, business or organisation, you confirm you are authorised to do so.

A.4 Purchasing and delivery

  • All purchases are made through our Tebex store. We do not take payment by any other method for store products.
  • Download links appear on your Tebex account page immediately after payment. Files always come from Tebex, never from Discord.
  • Your Discord roles unlock customer channels and support. They are not the product, and losing Discord access does not revoke your licence.
  • Prices are shown at checkout and may change at any time. A change never affects a purchase already made.

A.5 Your account and your links

Your Tebex account, order history and download links are yours alone. Sharing them is treated as redistribution under Document B.

A.6 Support

  • Support is provided through our Discord ticket system. Response target is 30–60 minutes during active hours and within 24 hours otherwise. These are targets, not guarantees.
  • We support our resources on a reasonably current framework and on an unmodified installation of the resource. We are not obliged to support a version you have modified, though we will usually try.
  • We are not obliged to make a resource work alongside every third-party resource in existence. Where a conflict cannot be resolved, Document C applies.
  • Updates are free for life for as long as we maintain a resource. We may discontinue a resource; if we do, your licence continues and downloads remain available through Tebex, but new updates stop.

A.7 Conduct, and what ends access

We may suspend or terminate Discord access, decline support, and decline future sales where you:

  • redistribute, resell, leak or share a resource, or your account or links;
  • remove, bypass or defeat escrow, licensing or authentication on any resource;
  • request, offer or link to leaked resources — ours or anyone else's;
  • abuse staff, or abuse the ticket system after being asked to stop;
  • initiate a chargeback rather than contacting us first.

On a chargeback or a confirmed redistribution, access to every package on the account is revoked. Your Discord roles are removed and support ends.

Note for review. A chargeback is a customer's right with their bank, and a

term that penalises exercising it is exactly the sort of clause a consumer

regulator looks at. This clause is currently framed as *withdrawal of a

discretionary service* (support, Discord, future sales) rather than as a

penalty. See §E.

A.8 Availability

We provide no guarantee of uninterrupted availability of the Discord, the store, or support. Tebex controls store and download availability, not us.

A.9 Liability

To the maximum extent permitted by law:

  • Resources are provided "as is" beyond the warranty in §C.2.
  • We are not liable for indirect or consequential loss, lost revenue, lost players, server downtime, or lost or corrupted data.
  • Our total liability to you is limited to what you paid for the resource giving rise to the claim.
  • Nothing here limits liability for fraud, wilful misconduct, death or personal injury, or anything that cannot be limited by law.

You are responsible for your own backups. Any migration or data tooling we provide is a convenience and does not replace them.

A.10 Changes

We may update these terms. The version in force is the one published when you purchase. Continuing to use the Discord or our resources after a change means you accept the updated terms.

A.11 Law

These terms are governed by the laws of the Commonwealth of Virginia, USA, without regard to its conflict-of-laws rules. Nothing here removes rights you have as a consumer under the law of your own country, which may give you rights these terms cannot override.
